Custody Conditions

  1. The Kent Historical Museum (KHM) will give the same care and respect to the item(s) on the Temporary Custody Receipt (TCR), as it does in the safekeeping of comparable property of its own. The Depositor releases the KHM from all liability with respect to any loss or damage to the item(s) while in possession or in transit and agrees that the KHM cannot cover such item(s) with insurance.

  2. Dates, attributions, and other information on this receipt are as given by the Depositor. The KHM does not appraise item(s) or endorse any valuations given by the Depositor.

  3. The KHM will not clean, restore or otherwise alter the item(s) while under the TCR.

  4. Items deposited for examinations may be retained by KHM for 60 days.

    • If the gift offer is accepted, the Deed of Gift form or Loan Agreement form will be sent for the Depositor’s signature and return.

    • If the offer is declined, the Depositor may at once reclaim the property.

    • Following the examination, if after 90 days and with no fault of its own, and all reasonable effort has been made by KHM to contact the Depositor, the item(s) will be deemed an unrestricted gift to the KHM to keep or dispose of at its discretion and without any liability to the Depositor.

  5. If the item(s) are to be returned, they will only be returned to the Depositor and address on the TCR, unless the KHM is notified by the Depositor in writing to the contrary. The TCR must accompany the written notice.

  6. If the item(s) are to be returned, the method and responsibility of return will be determined on a case by case basis. The Depositor must forward the TCR prior to return.

  7. If the legal ownership of the item(s) changes due to death, sale, etc., the new owner will be required to establish his legal right to receive the item(s) by proof to the KHM.

  8. The KHM accepts this deposit on the understanding that the Depositor has the full authority to make same. If accepted as a gift, the Depositor should have proof of full and clear title. Such a gift will be outright and unconditional to KHM.

  9. If item(s) are not accepted into the collection, and the Depositor has indicated on the TCR that he does not want the property returned, it is understood that the KHM is free to determine the disposition of the item(s), and can dispose of them as the KHM sees fit.
